1. About us
These terms apply to all orders placed through sloeandhurst.co.uk (the “Site”). Sloe & Hurst is a trading name of Joseph Lynch, a sole trader (“we”, “us”, “our”).
Address: Unit A, 82 James Carter Road, Mildenhall, IP28 7DE
Email: info@sloeandhurst.co.uk
By placing an order, you agree to these terms. Please read them, together with our Shipping & Payments information, Returns Policy and Privacy Policy, before you order. If you have any questions, contact us before buying.
2. Our products
We sell hand-poured wax melts and accessories, such as wax melt burners and tea lights. We take care to describe and photograph our products accurately, but please note:
- Handmade products vary slightly in colour, finish, weight and appearance. This is part of their character and is not a fault.
- Colours on screen may differ slightly from the real product
- Scent descriptions are our own interpretation. Fragrance is personal, and we can’t guarantee you’ll experience a scent in the same way we describe it.
- Scent strength and performance depend on your burner or vessel, room size and airflow
3. Safety and use
Our products must be used as directed. Safety information is provided on the packaging and product pages, and by buying you agree to follow it. In particular:
- Never leave a lit burner or candle unattended
- Keep products away from children, pets, flammable materials and draughts
- Use wax melts only in a suitable, stable wax melt burner, and follow the burner manufacturer’s instructions
- Never use products in a way they weren’t intended for, and do not ingest them
- Fragrance ingredients may cause reactions in some people. If you have allergies or sensitivities, check the product information or contact us before buying.
4. Placing an order and contract formation
- Our Site invites you to place an order. It is not an offer to sell.
- When you place an order, you’ll receive an email acknowledging it. This is not acceptance of your order.
- A contract between us is formed when we dispatch your order and send you a dispatch confirmation email (or, if earlier, when we confirm acceptance by email).
- If we can’t fulfil your order, for example because an item is out of stock, we’ll tell you promptly and refund anything you’ve paid.
- You must be at least 18 to place an order
5. Prices and availability
- All prices are in pounds sterling (GBP). We are not VAT registered, so no VAT is charged.
- Delivery costs are shown at checkout before you pay
- We take care to keep prices accurate. If we discover a pricing error after you’ve ordered, we’ll contact you, and you can then choose to confirm the order at the correct price or cancel it for a full refund. We aren’t obliged to supply goods at an incorrectly displayed price where the error was obvious and unmistakeable.
- Products are subject to availability
6. Payment
Payment is taken in full at checkout by card (via Stripe) or PayPal. We never see or store your full card details. Your order is only confirmed once payment has been successfully processed. We may cancel and refund an order if we suspect fraud or if payment can’t be verified.
7. Delivery
We deliver to addresses in Great Britain only (England, Scotland and Wales), by Royal Mail Tracked 48, as set out in our Shipping & Payments information. Delivery is £4.99 per order under £40, and free on orders of £40 or more. Delivery times are estimates, not guarantees. Please check your address carefully at checkout. Risk of loss or damage passes to you once the goods are delivered to you. Until then, they remain our responsibility.
8. Your right to cancel, returns and refunds
If you change your mind, you may cancel your order within 14 days of receiving it and must return the goods within 14 days of telling us, as set out in our Returns Policy. For change-of-mind returns, goods should be unused, unlit and in their original packaging, and we may reduce a refund where goods have lost value through use or handling. Refunds are made within 14 days of receiving your return, to the original payment method.
If goods are faulty, damaged or not as described, you’re entitled to a repair, replacement or refund under the Consumer Rights Act 2015, and we’ll cover return postage. Nothing in these terms affects your statutory rights.
9. Our responsibility to you
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but not for loss that wasn’t foreseeable.
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can’t legally be limited or excluded.
- We supply products for domestic and private use only. We aren’t liable for any loss of profit, loss of business or business interruption.
- We aren’t responsible for damage resulting from misuse of our products or failure to follow the safety instructions.
10. Events outside our control
We aren’t liable for delay or failure to perform caused by events outside our reasonable control, such as severe weather, postal or courier disruption, strikes, supply shortages or illness. If an event like this affects your order, we’ll contact you as soon as we can, and you may cancel the affected order for a refund.
11. Intellectual property
The Sloe & Hurst name, logo, label designs, photographs, text and other content on the Site belong to us or are used with permission and are protected by intellectual property laws. You may not copy, reproduce or use them commercially without our written permission. Buying our products doesn’t give you any rights to our branding, designs or product formulations.
12. Your information
We use your personal information as described in our Privacy Policy.
13. Complaints
If you’re unhappy, please contact us at info@sloeandhurst.co.uk and we’ll do our best to put things right, usually within 5 working days.
14. General
- Changes: We may update these terms from time to time. The terms in force when you place your order will apply to that order.
- Entire agreement: These terms, together with our policies, form the whole agreement between us for your order.
- Transfer: You may not transfer your rights under a contract with us to anyone else without our consent.
- Severance: If any part of these terms is unenforceable, the rest remains in force.
- Waiver: If we don’t enforce a right straight away, we haven’t given it up.
- Third parties: Only you and we have rights under the contract.
- Governing law: These terms are governed by the law of England and Wales. If you live in Scotland, you may bring proceedings in the Scottish courts, and any mandatory rights you have under Scottish law remain unaffected. Otherwise, the courts of England and Wales have jurisdiction.
